Terms for Australia Company Registration
My Shelf Company does not operate as an accounting practice, law firm or financial planner in any way. We do not give advice in these areas of business and urge you to seek the services of a licenced accountant, lawyer or financial planner for accurate advice in these areas. You will hold the responsibility to provide accurate information when completing your online (or other) registration.
After submitting your order, any amendments, updates or changes to your order may not be possible unless accepted by the My Shelf Company management team. Any amendments, updates or changes you request after submitting your order, will be deemed as billable at the discretion of the My Shelf Company management team.
Cancelling your order after submission is not possible. Delays in processing your order may be caused by ASIC systems issues, My Shelf Company server or systems issues or other causes that are beyond our control.
Your company documents will be sent to you by email to the email address provided by you during the completion of your order, only after our office has received the signed Director Consent (signed by the new director of your company), Use of Address Consent (signed by the new director of your company) and the Share Transfer Form (signed by the new shareholder of your company. In the instance where the new shareholder of the company is another company, then the director of the company that will hold the shares, will act as the signatory on the Share Transfer Form). We reserve the right to delay the delivery of your company documents until we have received the signed consents and share transfer form. Scanned, signed (in the manner outlined above) copies of the consents and the share transfer form are sufficient for the purpose of transferring ownership of the company you have purchased. If you or any agent, amend/s the ASIC registers manually, without first providing our office with the signed consents and share transfer form, we reserve the right for our staff to change the details recorded on the ASIC registers of the company you have purchased, back to those of the original officeholders who were appointed prior to the sale of the company and to continue to do so, until the signed consents and share transfer form are received by our office.
Proof of Identity may be requested at any time, in particular if the automated system flags your application for manual review. The required evidence will be government issued photo identification such as Australia Divers License, Passport from any Jurisdiction, Australian Proof of Age Card or other identification if these are unavailable.
The uploaded government issued photo identification must belong to the new Public Officer. The signature on the uploaded government issued photo identification must match the signature of the Public Officer as applied to the Public Officer consent. If the signature on the uploaded government issued photo identification does not match the signature on the Public Officer consent, the company ABN will be cancelled. No refund will be provided for cancellation of the company ABN under these circumstances.
If no Public Officer consent is provided for an order or, the Public Officer consent is not signed, then the company ABN will be cancelled. No refund will be provided for cancellation of the company ABN under these circumstances.
Documentation provided for your company is to be used only for the purposes for which the company was ordered.
Copying or reproduction of the provided documents is only permitted for use in relation to transactions for which the company was ordered.
ABN (Australian Business Number) Terms of registration
All details and information provided during the application is your responsibility and we are not required to check for errors or information which may be incorrect. Registration of your Australian Business Number may be delayed due to the Australian Tax Office withholding the order, technical issues or other unrelated delays.
The main business activity you provide to My Shelf Company Pty Ltd for the update of the company ABN will be matched as closely as possible to the business types currently listed and administered by the Australian Taxation Office (ATO). See ATO BUSINESS INDUSTRY CODES for further information.
Applications may be rejected by the ATO or held for up to 28 days by the ATO. My Shelf Company will endeavour to communicate with the ATO on your behalf if there is any delay in your application until it is concluded with acceptance or rejection.
Updating your details with the ATO and ABR with regard to the company ABN and TFN can take up to 28 days. You agree that My Shelf Company Pty Ltd and its director shall be entirely indemnified against any and all loss of earnings and potential loss of earnings, that may occur as a result of any such delay.
Any Tax Returns that fall due subsequent to the sale of any shelf company, shall be the sole responsibility of the purchaser.
Any and all ASIC fees incurred subsequent to the sale of any shelf company, shall be the sole responsibility of the purchaser.
My Shelf Company will not be considered as your tax agent. Your ABN and TFN will be sent to you fromMy Shelf Company by email.
Intellectual property rights
Any and all material on the Website such as domain names, names, text, graphics, images, photographs, illustrations, diagrams, logos, buttons, icons, software, and other items, services, processes and technologies described on the Website are owned by My Shelf Company, its suppliers, related bodies corporate or others who have licensed their material to My Shelf Company.

All forms on this site are to be completed manually and the use of any auto-complete or spider technology is prohibited, unless it is part of your standard software system designed to auto-fill repeated entries.

As an affiliate of My Shelf Company Pty Ltd you will be provide with an administration panel where you can monitor all generated visits, all generated referrals and all commissions.
You will also be provided with a creative section within your account area where you will find and be able to utilise, free of charge, banners and other advertising materials to assist with building and enhancing your online profile.
Subsequent to each sale, you will receive a $25.00 store credit. Store credits cannot be withdrawn at any time nor can they be redeemed as cash.

In order to prevent fraud, cover charge backs and or refunds, commissions will be held in a pending state for 30 days after each purchase has been completed.

- Add a delayed payment fee of $10 for each week the bill remains outstanding.
- Refer the bill to a collection agency. If your bill is referred to a collection agency a charge will be added to bring the bill to the least amount required by the agency and to also cover the fee charged to recoup the billed amount.
Unless otherwise specified, My Shelf Company will not offer a refund or credit on purchases made through this website unless required under Australian consumer law or other relevant consumer protection laws. In cases where a refund is agreed to, the refund may take up to 30 days. All clients of My Shelf Company Pty Ltd acknowledge and agree that no claims, suits, class actions or recompense of any kind, will be sought for refunds that occur within a 30 day period from the date that ARD Corporate Services Pty Ltd agrees to make said refund.
